What is Reckless / Private Pilot Remuneration

The following judgment from a case brought by Transport Canada against a private pilot is very interesting reading.  It really explains very clearly the process that is used to make some of these determinations.  http://www.tatc.gc.ca/decision/decision.php?lang=en&dc_id=1498

In respect to passengers sharing the cost of a flight:  the passengers in a private flight must be incidental to the flight.  The pilot must have been going anyway and would go even if the passengers were not along for the ride.

In respect to reckless behavior:  the pilot will be subjected to a "reasonableness" test.  If the judge thinks the behavior was reasonable in the circumstances then it isn't a problem.
